Terms of Service

1. The agreement

These Terms of Service ("Terms") are a binding agreement between you and FightTech ("we", "us") covering the FilMode Android application, published as app.filmode.videomaker, and the website at videomaker.filmode.app (together, the "Service"). They do not cover ProCut, our cross-platform edition, which has its own terms. By installing or using FilMode you accept these Terms. If you do not accept them, do not use the Service.

Our Privacy Policy is incorporated into these Terms by reference.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher, to use FilMode. If you are under the age of majority, you may use it only with the involvement of a parent or guardian who agrees to these Terms on your behalf. If you use FilMode for an organisation, you confirm you are authorised to bind that organisation.

3. Your licence to use FilMode

We grant you a personal, worldwide, non-exclusive, non-transferable, revocable licence to install and use FilMode on devices you own or control, for personal or commercial video production, subject to these Terms and to the app store rules that apply to your download.

You may not: reverse engineer, decompile or disassemble the app except to the extent that applicable law expressly permits it; circumvent or tamper with licensing or purchase validation; rent, lease, resell or sublicense the app; or remove proprietary notices.

4. Your content

You keep all rights in your content. Video, audio, images, text and projects you create or import remain yours. We claim no ownership over them and no licence to use them for marketing, training or anything else.

FilMode edits on your device, and its AI features do too, so we never receive your content at all — there is no exception and no upload path. We therefore ask for no licence over it of any kind (see Privacy §5).

You are responsible for having the rights to everything you import, including music, footage, fonts and any person's likeness. Exports carry no watermark, so nothing in the app signals to a third party that you had permission — that part is on you.

Back up your work. Projects live on your device. We hold no copy and cannot recover a project lost to a device failure, an uninstall or a deleted source file.

5. Built-in assets, music and fonts

FilMode ships with templates, transitions, effects, stickers, fonts and audio. You may use them inside videos you produce with FilMode, including commercially. You may not extract them and redistribute them as standalone assets, or use them in a product that competes with FilMode.

Some assets come from third parties under their own licences, listed in the app under Settings → Licences. Where a licence requires attribution, that requirement passes to you.

6. Acceptable use

You agree not to use FilMode to create, edit or distribute material that:

• infringes anyone's copyright, trademark, privacy or publicity rights;
• sexualises minors, in any form;
• is non-consensual intimate imagery, or depicts a real person doing or saying something they did not do in a way intended to deceive;
• harasses, threatens or incites violence against people;
• promotes terrorism or violent extremism;
• is fraudulent, or impersonates a person or organisation to deceive; or
• breaks any law that applies to you.

Because editing happens on your device, we cannot and do not monitor what you make. This section states what the licence permits; because nothing you make passes through us, there is nothing for us to enforce it against.

7. AI features

AI output is generated automatically and may be inaccurate, unoriginal or unsuitable for your purpose. Automatic captions in particular will contain errors — check them before publishing anything where accuracy matters.

Every AI feature runs on your device: we neither receive the input nor produce the output, and we sell no AI service, credits or per-use billing of any kind. You are responsible for reviewing AI output before you use it, and for not using it to generate content prohibited by section 6. We make no representation that AI output is free of third-party rights, and we claim none in it.

8. Paid plans and billing

8.1 What's free

The core editor — import, cut, trim, transitions, text, audio, export up to the resolution stated on the pricing page — is free, with no watermark and no time limit. On-device AI features are included at no cost.

8.2 Subscriptions

FilMode Pro is sold as an auto-renewing subscription through Google Play. Payment is charged to your store account at confirmation of purchase. The subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours before the period ends.

You manage and cancel subscriptions in your store account, not in FilMode — see how to cancel. Deleting the app does not cancel a subscription.

If we raise the price, the increase applies only after we notify you and, where the store requires it, only after you consent. Otherwise the subscription simply stops renewing.

8.3 One-time purchase

FilMode Pro Lifetime is a single purchase, not a subscription: nothing renews and there is nothing to cancel. It is tied to the Google account that bought it and can be restored on your other devices from that account. It does not carry over to ProCut, which is a separate app with a separate purchase.

8.4 Taxes

Prices shown in the store include or exclude tax according to the store's rules for your country. The store, not us, sets the local price and handles tax.

9. Refunds

Google is the merchant of record. Refund requests go to Google, under its policy — start at Play subscriptions or Google Play support.

Nothing here limits statutory withdrawal or refund rights you have as a consumer, including the EU right of withdrawal for digital content. If a store declines a refund you believe you are legally entitled to, contact us and we will help.

10. Changes to the app

We improve FilMode continuously and may add, change or remove features. If we remove or materially degrade a feature that is a core part of a plan you are paying for, you may cancel and we will not oppose a pro-rata refund request for the unused period. We will give reasonable advance notice in the app before discontinuing the Service entirely.

We may update these Terms. Material changes take effect 30 days after we post them, or on the date required by law if sooner, and we will show a notice in the app. Continuing to use FilMode after that date means you accept the new Terms.

11. Our intellectual property

FilMode, its name, logo, user interface, source code and bundled assets are owned by FightTech or its licensors and are protected by copyright and trademark law. These Terms grant you a licence to use the app, not any ownership of it.

FilMode is an independent product. It is not affiliated with, endorsed by or sponsored by Wondershare, Filmora, Bytedance, CapCut or Google. Product names mentioned for comparison belong to their respective owners.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted or error-free, that exports will succeed on every device or with every codec, or that AI output will meet your expectations. Video encoding depends on your device's hardware; results vary by model, thermal state and available storage.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Where you are a consumer, your statutory rights are unaffected.

13. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of the Service — including lost projects or footage.

Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) USD 50.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

14. Indemnity

You agree to indemnify and hold FightTech harmless from third-party claims arising out of content you create, import or publish with FilMode, or out of your breach of these Terms — except to the extent the claim results from our own breach or negligence. This does not apply where you are a consumer and local law prohibits it.

15. Suspension and termination

You may stop using FilMode at any time by uninstalling it. Because the app runs entirely on your device, there is no account or service for us to switch off; if you materially breach these Terms, the licence in section 3 ends and you must stop using the app.

If we terminate you without cause, we refund the unused portion of any prepaid subscription. Sections 4, 11, 12, 13, 14 and 16 survive termination.

16. Governing law and disputes

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law rules. The courts of Vietnam have jurisdiction over disputes arising from them.

If you are a consumer resident in the EEA, the UK or another jurisdiction whose law grants you the right to bring proceedings locally and to the protection of your own consumer law, that right is unaffected by this section.

Before starting formal proceedings, please write to us — we will make a genuine effort to resolve the matter within 30 days.

17. Google Play terms

When you obtain FilMode from Google Play, the Google Play Terms of Service also apply to your download and purchases. Google is not a party to these Terms and is not responsible for FilMode. Refunds for Play purchases follow Google's policy.

18. General

• Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.
• Severability. If a provision is unenforceable, the rest stays in force.
• No waiver. Not enforcing a provision once does not waive it.
• Assignment. You may not assign these Terms. We may assign them in a merger or sale of assets, on notice to you.
• Force majeure. Neither party is liable for delay caused by events beyond its reasonable control.
• Language. These Terms are drafted in English. A translation is provided for convenience; the English version governs.
